9. Insurance Requirements

(a) All Guests must hold valid travel insurance that includes cover for emergency medical treatment and medical evacuation before registration and travel to the Resort. Guests are solely responsible for ensuring that their policy is suitable for travel to a remote island location and provides adequate cover for emergency medical treatment, evacuation and associated transport costs. Tanah Mympi may request evidence of this cover at registration.

(b) Tanah Mympi strongly recommends that Guests’ travel insurance also includes cover for cancellation, curtailment, travel disruption and loss of or damage to baggage and sporting equipment, including surfboards.

(c) Tanah Mympi accepts no responsibility for any loss, cost or expense that would have been covered by appropriate travel insurance.

10. Travel Documentation and Entry Requirements

(a) Guests are solely responsible for ensuring that they hold all travel documents, visas, permits and health or customs declarations required for travel.

(b) A valid passport must be produced at check-in. For travel to Indonesia, passports must be valid for at least six months from the date of departure from Indonesia.

Coordination details will be provided to Guests before arrival. Orientation, including safety and arrival procedures, will be provided on arrival at the Resort.

(d) All transfer arrangements are subject to scheduling, weather conditions, operational requirements and the Guest’s confirmed itinerary. Tanah Mympi is not responsible for any costs, lost nights or missed services resulting from a Guest’s late arrival, inaccurate or late information provided by the Guest, airline schedule changes, or any other transfer delay outside Tanah Mympi’s reasonable control, and no refund or credit will be given.

(e) Air transfers are subject to baggage weight and size limits, which will be advised before arrival. Excess baggage, including surfboards and other oversized items, may incur additional charges or need to be transported separately.

(f) Guests who elect to arrange their own transport between Padang and Telo do so entirely at their own risk and expense, and no refund or credit will be given for the unused transfer. Tanah Mympi accepts no responsibility or liability for any delay, cancellation, missed connection, loss, damage, injury, cost or expense arising from or in connection with any transport not arranged or expressly confirmed in writing by Tanah Mympi.

(i) decline to arrange transfers or other services for that Guest until registration is complete;

(ii) refuse check-in or travel to the Resort where the missing information is required for safety, insurance, transport or legal compliance purposes; or

(iii) treat the Reservation for that Guest as cancelled by the Guest, in which case the cancellation charges in clause 6.1 will apply.

(f) Tanah Mympi is not responsible for any cost, loss or missed service arising from late or incomplete registration, and no refund or credit will be given.

13. Guest Responsibilities and Conduct

(a) Guests must comply with all Resort policies, safety requirements, applicable laws and all reasonable directions of Tanah Mympi staff.

(b) Tanah Mympi may refuse service, remove a Guest from the Resort or cancel any remaining services where a Guest engages in unlawful, unsafe, abusive or materially disruptive conduct, or otherwise creates a material risk to persons, property, operations or the experience of other Guests.

(c) Tanah Mympi has a zero-tolerance policy on illegal drugs. Possession or use of illegal drugs in Indonesia carries severe legal penalties. Any Guest found in possession of, or using, illegal substances will be required to leave the Resort immediately and may be reported to the relevant authorities where required by law.

(d) Where a Guest is removed from the Resort or services are cancelled under this clause, no refund, credit or compensation will be provided, and the Guest is responsible for all costs of departure, including transport and accommodation.

(e) Guests are liable for any loss of, or damage to, Resort property caused by them or any member of their party, and Tanah Mympi may charge the cost of repair or replacement to the credit card on file.

14. Surfing, Water Activities and Assumption of Risk

(a) Guests acknowledge that surfing, boat transfers, snorkelling, swimming and other water-based and recreational activities (“Activities”) involve inherent risks, including risks arising from waves, reefs, currents, marine life, weather and sea conditions, equipment and the actions of other participants. These risks may result in serious injury, illness or death.

(b) Participation in any Activity is entirely voluntary and at the Guest’s own risk. Guests are solely responsible for assessing whether an Activity is suitable for their ability, experience, fitness and health.

(c) Guests warrant that they are in good health, medically fit to participate in the Activities they undertake, and competent swimmers. Guests must disclose at registration any medical condition that may affect their safety or the safety of others.

(d) Guests must observe surf etiquette and comply with all safety briefings, guide instructions and water-based operational directions issued by Tanah Mympi staff or guides. Tanah Mympi may restrict or refuse a Guest’s participation in any Activity where it reasonably considers that the Guest’s ability, health or conduct, or the prevailing conditions, present an unacceptable risk.

(e) Guests must not participate in any Activity while under the influence of alcohol or any other substance that may impair their judgement or ability.

(f) Guests acknowledge that the Resort is in a remote island location, that on-site medical facilities and first-aid capability are limited, and that access to hospital-level care may require evacuation by air or sea. Evacuation may be delayed or prevented by weather, sea conditions, transport availability or other factors beyond Tanah Mympi’s control. All costs of medical treatment and evacuation are the Guest’s responsibility.

(g) Guests under 18 years of age may participate in Activities only with the consent of, and under the supervision of, a parent or legal guardian, who accepts responsibility for the minor’s participation.

(h) Tanah Mympi may require Guests to sign a separate activity waiver or acknowledgement before participating in any Activity.

(d) Laundry services are provided in accordance with the Guest’s Reservation. Additional services may incur extra charges.

(f) Tanah Mympi operates sustainability practices across the Resort, and Guests are asked to support these during their stay. Guests are encouraged to use reef-friendly sun protection and to act responsibly to protect the local marine environment.

16. Limitation of Liability

(a) To the fullest extent permitted by applicable law, Tanah Mympi excludes all liability for any indirect, consequential, incidental, exemplary or special loss, damage, cost or expense, including any loss of enjoyment, opportunity or benefit, and any loss arising from third-party services, travel delays or events beyond Tanah Mympi’s reasonable control.

(b) Where liability cannot be excluded, Tanah Mympi’s liability is limited to the maximum extent permitted by law.

17. Privacy and Guest Information

(a) Tanah Mympi may collect, use and disclose personal information reasonably required to administer Reservations, Guest registration, transport, operational coordination, safety, legal compliance and Guest services.

(b) Personal information may be disclosed to third parties where reasonably necessary for these purposes, including transport and transfer providers, insurers, medical and emergency service providers, payment processors, and government, immigration or law enforcement authorities where required or authorised by law.

(d) These Terms are governed by the laws of Australia and Indonesia, and the parties submit to the non-exclusive jurisdiction of the courts of that place
