Terms and Conditions of Booking

Important Notice
These Terms and Conditions set out the basis on which Tanah Mympi accepts and provides reservations, accommodation, curated packages, transfers and related guest services. By making, confirming or paying for a reservation, the booking party agrees to be bound by these Terms in their own capacity and on behalf of each guest included in the reservation.
1. Parties
These Terms and Conditions of Booking form the agreement between Tanah Mympi as provider of accommodation and related guest services and the person making the reservation, who contracts on their own behalf and, where applicable, as agent for each guest included in the booking.
2. Definitions and Interpretation
In these Terms, “Resort”, “we”, “us” and “our” mean Tanah Mympi and, where the context requires, its related bodies corporate, operators, employees, contractors and authorised representatives. “Guest”, “you” and “your” mean the person making the booking and each person included in the reservation. A reference to a booking or reservation includes accommodation, curated packages, transfers and any related services confirmed by Tanah Mympi. Headings are for convenience only and do not affect interpretation. Unless the context otherwise requires, the singular includes the plural and vice versa.
3. Bookings and Payment Terms
3.1 Payment Methods
Payments must be made in Australian Dollars (AUD) or United States Dollars (USD) by approved electronic payment methods, including credit card and, where available, bank transfer or ACH. Cash payments are not accepted.
3.2 Deposit and Confirmation
A non-refundable deposit equal to 50% of the total booking value per guest is payable at the time of booking in order to secure the reservation. A reservation is not binding on Tanah Mympi until the required deposit or full payment, as applicable, has been received in cleared funds.
3.3 Final Payment
The balance of the booking price must be paid in full no later than 90 days before the scheduled check-in date, unless otherwise agreed by Tanah Mympi in writing.
3.4 Third-Party Bookings
Where a reservation is made through a travel agent, online travel agency or other third-party intermediary, additional terms, conditions and payment schedules may apply. Tanah Mympi accepts no responsibility for the acts, omissions, defaults or insolvency of any third-party intermediary. If a third-party intermediary fails to remit payment when due, Tanah Mympi reserves the right to contact the guest directly and, where authorised, charge the outstanding balance to the credit card held on file in order to maintain the reservation.
3.5 Failure to Pay
If payment is not received by the due date, Tanah Mympi may, without prejudice to any other right or remedy available to it, cancel the reservation, retain any amounts previously paid and release the reserved dates or services, subject always to any rights or remedies that cannot be excluded under applicable law.
4. Pricing and Package Inclusions
4.1 Included Services
Rates, packages, and included services may vary according to occupancy, length of stay, travel season, and any exclusive offer available at the time of booking. Tanah Mympi reserves the right to amend pricing, package inclusions, and availability at any time before a reservation is confirmed. Once confirmed, the contracted rate will remain unchanged except where the guest requests an amendment, a manifest error requires correction, or an adjustment is otherwise permitted by law.
4.2 Exclusions
Unless expressly stated otherwise in writing, package pricing excludes international and domestic airfares, accommodation outside the confirmed stay period, travel insurance, visa costs, passport fees, personal expenses, excess baggage charges, and any third-party services not expressly described as included in the confirmed booking.Any service, product, activity, or item not expressly listed as included in the confirmed booking will be at the guest’s expense and may be charged separately at the prevailing rate.
5. Booking Changes and Transfers
Subject to availability and Tanah Mympi’s prior written approval, a confirmed booking may be transferred to another guest up to 90 days before check-in. An administration fee of 350 USD or 500 AUD per guest applies to each approved transfer and is payable when the transfer is processed. Tanah Mympi may refuse any transfer request where the replacement guest does not satisfy applicable booking, identification or travel requirements.
6. Cancellations, Refunds and Rebooking
6.1 Non-Refundable Payments
Except to the extent otherwise required by applicable law, all amounts paid toward a reservation are non-refundable. No refund, credit, set-off or reduction will be available in respect of change of mind, adverse weather, surf conditions, delayed or cancelled transport, force majeure events, missed connections, late arrivals, early departures or any unused portion of the confirmed stay.
6.2 Additional Costs
If a guest’s return or onward travel is delayed for any reason, the guest is responsible for all additional accommodation, transfer, meal and incidental costs unless Tanah Mympi expressly agrees otherwise in writing.
6.3 Insurance Recommendation
Guests are strongly encouraged to obtain comprehensive travel insurance, including cover for cancellation, curtailment, medical treatment, evacuation, baggage and travel disruption.
6.4 Rebooking Requests
Requests to amend travel dates or rebook a reservation may be considered at Tanah Mympi’s discretion and are subject to availability, prevailing rates and the fee schedule in Schedule 1. All amendment and rebooking requests must be submitted in writing to the reservations team and are not effective until confirmed by Tanah Mympi in writing. No refund, credit or reduction will be provided in respect of no-shows, unused nights or early departures.
7. Force Majeure
To the maximum extent permitted by law, Tanah Mympi is not liable for any delay, failure, interruption, loss, damage, cost or expense arising from or in connection with an event beyond its reasonable control, including any natural disaster, severe weather event, fire, flood, pandemic, epidemic, government restriction, change in law, closure of an airport or port, transportation disruption, labour dispute, civil unrest, act of terrorism or other force majeure event.
8. Travel Disruption and Trip Interruption
Tanah Mympi is not liable for any loss, cost, inconvenience or disruption arising from travel interruption or transport-related events.
Missed, cancelled, rescheduled or delayed flights, ferries or other transport services.
Lost, delayed or damaged luggage, sporting equipment or personal belongings, including surfboards.
Any additional costs incurred as a result of missed connections, delayed departures, altered travel plans or extended stays may be charged to the guest’s credit card on file unless alternative payment arrangements are agreed in advance in writing.
9. Insurance Requirements
All guests must hold valid medical evacuation insurance before registration and travel to the resort. Guests are solely responsible for ensuring that their insurance policy is suitable for remote island travel and provides adequate cover for emergency medical treatment, evacuation and associated transport costs. Tanah Mympi also strongly recommends that guests obtain travel disruption, cancellation and baggage insurance before departure.
10. Travel Documentation and Entry Requirements
Guests are solely responsible for ensuring that they hold all travel documents, visas, permits and health or customs declarations required for travel. A valid passport must be produced at check-in and, for travel to Indonesia, passports must generally be valid for at least six months from the date of entry. Where requested, guests must also provide passport details and any other documentation reasonably required for registration, transport or compliance purposes.
11. Transfers and Transportation
Where included in the confirmed booking, Tanah Mympi will arrange airport transfer services from Padang Airport in accordance with the guest’s confirmed itinerary. Guests must provide accurate arrival and departure details within the required timeframes. Tanah Mympi is not liable for missed transfers resulting from inaccurate information, delayed document submission, airline schedule changes or events beyond its reasonable control.
12. Arrival and Logistics
Guests should arrive in Padang by 8:00 AM or the night prior, where applicable, and follow all pre-arrival instructions provided by Tanah Mympi.
Dependent on the confirmed booking package, travel arrangements may include a private charter flight from Padang to Telo or a boat transfer from Padang to Telo followed by a direct boat transfer arrangements to Tanah Mympi.
All transfer arrangements are subject to scheduling, weather conditions, operational requirements and the guest’s confirmed itinerary.
Guests will receive coordination details prior to arrival. Orientation, including relevant safety and arrival procedures, may be provided on arrival where applicable.
13. Guest Registration and Information
All guests must complete Tanah Mympi’s registration requirements no later than 30 days before check-in. Required information may include travel dates, booking reference details, passport information, emergency contact details and insurance particulars. The person making the booking warrants that all information provided to Tanah Mympi is complete, current and accurate. A parent or legal guardian must complete the registration requirements for any guest under 18 years of age.
14. Guest Responsibilities and Conduct
Guests must comply with all resort policies, safety requirements, applicable laws and all reasonable directions of Tanah Mympi staff. Tanah Mympi may refuse service, remove a guest from the property or cancel any remaining services without refund where a guest engages in unlawful, unsafe, abusive or materially disruptive conduct, or otherwise creates a material risk to persons, property, operations or the experience of other guests.
Zero tolerance for illegal drugs applies at all times. Drug use and possession in Indonesia carry severe legal consequences. Any guest found with illegal substances may be required to vacate the premises immediately and may be reported to the relevant authorities where required by law.
Guests are expected to respect surf etiquette, safety briefings and any water-based operational directions issued by resort staff or guides.
15. Guest Experience and Property Guidelines
Smoking is permitted only in designated outdoor areas.
Each villa is equipped with a safe for valuables; however, guests remain responsible for their personal belongings.
Daily housekeeping and standard guest services will be provided unless otherwise advised or requested.
Laundry services, power access and sustainability initiatives may be provided as part of the guest experience in accordance with the confirmed booking package and resort operations.
Guests are encouraged to use reef-friendly sun protection and act responsibly in support of the local marine environment.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Tanah Mympi excludes all liability for any indirect, consequential, incidental, exemplary or special loss, damage, cost or expense, including any loss of enjoyment, opportunity or benefit, and any loss arising from third-party services, travel delays or events beyond Tanah Mympi’s reasonable control. Where liability cannot be excluded, Tanah Mympi’s liability is limited to the maximum extent permitted by law.
17. Privacy and Guest Information
Tanah Mympi may collect, use and disclose personal information reasonably required to administer bookings, guest registration, transport, operational coordination, legal compliance and guest services. Guests warrant that they have authority to provide personal information for each person included in the booking. Tanah Mympi will handle personal information in accordance with applicable privacy laws and its internal privacy practices.
18. General Provisions
Tanah Mympi may amend these Terms and Conditions of Booking at any time before a reservation is confirmed. No variation to a confirmed booking or to these Terms is binding unless made in writing by an authorised representative of Tanah Mympi.
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be read down to the extent necessary and the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between the parties in relation to the booking, except to the extent otherwise required by law.
A failure or delay by Tanah Mympi to exercise a right under these Terms does not operate as a waiver of that right.
